By using this site or making a purchase, the user agrees to these terms. December Moon Designs LLC, reserves the right to update these terms at any time.
Products & Made-to-Order Specifics
Accuracy: While we strive for accuracy, product colors or details may vary slightly due to screen settings or the handcrafted nature of the jewelry.
Production Lead Times: Made-to-order items require 2-3 weeks for production before shipping.
Availability: We reserve the right to limit quantities or cancel orders if an item is unexpectedly out of stock.
Intellectual Property
Users are granted a limited license for personal use but cannot copy or resell December Moon Designs, LLC, content without permission.
Limitation of Liability & Disclaimers
"As Is" Basis: The website is provided without warranties of any kind.
Liability Cap: Damages (like a late delivery or a website glitch) to the amount the customer paid for the order.
Governing Law & Jurisdiction
Governing Law: These Terms and any dispute of any sort that might arise between you and December Moon Designs, LLC, shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.
Jurisdiction: You agree that any legal action or proceeding not subject to arbitration (as defined below) shall be brought exclusively in the state or federal courts located in Clark County, Washington, and you hereby consent to the personal jurisdiction and venue of such courts.
Dispute Resolution: Mandatory Arbitration & Class Action Waiver
Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or your use of this website—including the purchase of any handmade jewelry—shall be settled by binding arbitration. The arbitration shall be administered by [e.g., Washington Arbitration & Mediation Service (WAMS) or JAMS] in accordance with its consumer arbitration rules. The place of arbitration shall be Camas, Washington. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.
Class Action Waiver: YOU AND December Moon Designs, LLC, AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and December Moon Designs, LCC, agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Small Claims Exception: Notwithstanding the above, either party may elect to pursue a claim in Washington Small Claims Court for disputes within the scope of that court's jurisdiction (currently claims of $10,000 or less for businesses).
User Accounts & Conduct
The customer is responsible for maintaining password security. Unlawful behavior, such as using the site for spam or fraud is strictly prohibited.
